THE U. S. COURT AGAIN IN SESSION.
SALT LAKE, November 20th.—The United States District Court resumed its sessions this morning, Judge McKean, presiding. The cases of the people vs. John Redding, for assault with intent to kill; James Harrington, for murder; John Allen, for murder, and Daniel H. Wells, for lewd and lascivious cohabitation, were passed by consent of the counsel. In the case of
BRIGHAM YOUNG,
for lewd and lascivious cohabitation, Hon. Charles H. Hempsted moved that the trial be continued to the March term. The prosecuting attorney objected to this, remarking, "we only knew through the public newspapers that he has passed beyond the jurisdiction of this Court, or at least out of this Judicial District, when he is under recognition here, to appear from day to day, and not depart from the Court without leave. If the gentleman desire a con-tinuance in that case, I will demand a showing on affidavit."
BRIGHAM'S ABSENCE EXPLAINED.
Mr. Hempsted rejoined that his client was not absent, and did not intend to absent himself from the territory, but, being in ill health, he had gone South, as had been his custom for several years past; and, further, on this occasion he had gone with the entire approval of his counsel, and whenever the case might be set for trial he, Brigham Young, would be personally present in the court to answer any charges that might be brought against him.
Mr. Hempsted concluding by assuring the court that Brigham Young had not fled from the Territory, nor the jurisdiction of the court, nor did he intend to do so. He will be here, said Mr. Hempsted, any time his presence may be required. Relying upon his counsel to make the statement that I do make, that he is desirous of not coming here in cold weather, because his health is feeble, but if the interests of public service require it he will be here at any time required by your honor.
The counsel for the prosecution objected to the postponements saying that they were ready for trial now.
FORBEARING.
Judge McKean said: I will not at present either grant that motion, or will set down the case for any particular day. I will hold that under advisement.
THE OTHER SAINTS.
In the cases of Wm. Hickman, Dr. Wells, Hosea Stout, M. Meachan, Wm. Kimball, and others for murder; Henry Lawrence, Ornise Bates, and H. B. Clawson for lascivious cohabi-tation, a motion for a continuance was granted till next Monday. The indictment against Clawson, who is Superintendent of Zion's Co-operative Mercantile Institution, was found to-day. HAWKINS. In the case of Thomas Hawkins, Mr. Baskin asked for a mitimus to consign the prisoner to the penitentiary, and the matter was taken un-der advisement.
