Notes	(as told by Romer Grey) "Zane Grey wrote a novel which he called 'Born to the West' based upon parts of the life of Jesse Smith [husband of Lillian Wilhelm] which Jesse told him about. Mrs. Zane Grey sold this to The Country Gentleman Magazine for serialization before the book was published. Paramount, at the same time, had an option on all Zane Grey properties (both published and unpublished) and somehow they knew about or heard about 'Born to the West' before the Country Gentleman Magazine published it. This, of course, made the editor of Country Gentleman very angry. Mrs. Zane Grey offered to give back the money for the serial rights, but this editor, whose name I don't recall at the moment, finally suggested that she change the story slightly, change the names of the characters, and give it another title, which she did. Therefore, it was published by the Country Gentleman as 'Open Range.' When subsequently Paramount learned about the publication of 'Open Range' they called up and said they wanted to exercise their option on it. Mother told them that they had already bought motion picture rights of the story under the title 'Born to the West.' Henry Herzbrun, then head of the legal department at Paramount and eventually to become vice president in charge of production, checked with his producer and found that they wanted 'Open Range' anyway. So, actually, they brought the same story twice, were informed of the fact by Mrs. Zane Grey and still insisted on it; and quite contrary to a later story published in 'Variety' there was no subterfuge on the part of the Zane Grey's. Henry Herzbrun said that the producer liked the title 'Open Range' and he wanted the rights to it."
